The members of the commission are appointed by order of the Minister for the Economy for a renewable term of three years, on the recommendation of the Vice-President of the Conseil d’Etat in the case of the Conseiller d’Etat and on the recommendation of the First President of the Cour de Cassation in the case of the Conseiller à la Cour de Cassation.

The chairman and vice-chairman of the commission receive an annual flat-rate allowance, the amount of which is set by joint order of the ministers responsible for the economy and the budget. The Commission may call on rapporteurs belonging to the government departments in charge of the sectors of activity concerned to examine the files needed to draw up the list of ombudsmen notified to the European Commission, as well as to assess them, in accordance with Article L. 615-1. The commission examines the applications of persons wishing to be included on the list of consumer mediators in the light of the information communicated pursuant to article R. 614-3 and decides on their inclusion on this list.

The Commission shall notify the European Commission, pursuant to Article L. 615-1, the list of consumer mediators, specifying that they meet the quality requirements and fulfil the conditions laid down in articles R. 612-1 to R. 612-5. The Commission regularly assesses mediators to check that they still meet the conditions and quality requirements specific to the exercise of the mission of consumer mediator.

The Commission makes the updated list of mediators available to the public on its website and provides the link to the European Commission’s website dedicated to consumer mediation as well as the link to the website of the European Consumer Centre France.This list is also published in the Bulletin officiel de la concurrence, de la consommation et de la répression des fraudes.

The commission may hear any person and be provided with any document with a view to carrying out its mission.The secretariat is provided by the Directorate-General for Competition, Consumer Affairs and Fraud Control. It is responsible for assisting the Commission in its work, taking applications from people wishing to be included on the list of mediators and informing the latter of decisions made by the Commission.
