The contract for the transfer of exploitation rights or the marketing mandate contract includes a clause recalling the obligations resulting from article L. 213-28.

The obligations resulting from article L. 213-28 are not applicable to operators of cinematographic entertainment establishments, television service publishers or on-demand audiovisual media service publishers in respect of the acquisition of broadcasting rights or rights to make available to the public on the services they publish in return for a fixed and definitive price.
