The parties to an administrative contract may have recourse to a third party conciliator or mediator under the conditions laid down by the Chapters Iand II du titre II du livre IV du code des relations entre le public et l’administration.
The parties to a private law concession contract may have recourse to a third party conciliator or mediator under the conditions laid down by the provisions of Chapter I of Title VI of Book I and Chapter II of Title I of Book V of the Code of Civil Procedure.
The parties to a concession contract may reach a settlement as provided for in article 2044 of the French Civil Code.
As stipulated in the first paragraph of article 2060 of the Civil Code, granting authorities that are legal entities governed by public law may not resort to arbitration, except in the cases provided for by law, in particular those mentioned in article L. 311-6 of the Code of Administrative Justice.
Recourse to arbitration for the settlement of disputes between private parties in the performance of concession contracts is possible under the conditions defined by the Book IV of the code of civil procedure.
