Article L3137-4 of the French Public procurement code

As stipulated in the first paragraph of article 2060 of the Civil Code, granting authorities that are legal entities governed by public law may not resort to arbitration, except in the cases provided for by law, in particular those mentioned in article L. 311-6 of the Code of Administrative Justice.

Ainsi qu’en dispose le premier alinéa de l’article 2060 du code civil, les autorités concédantes qui sont des personnes morales de droit public ne peuvent recourir à l’arbitrage, sauf dans les cas prévus par la loi, notamment ceux mentionnés par l’article L. 311-6 du code de justice administrative.
