Section 1: Prior publicity

The conceding authority that intends to award a concession contract shall publish a concession notice, which shall include a description of the concession and the conditions for participation in the award procedure.The concession notice shall be drawn up in accordance with the model laid down by an order of the Minister for the Economy appended to this Code.

The awarding authority publishes the concession notice in the Bulletin officiel des annonces des marchés publics or in a legal gazette.It assesses whether, given the nature or value of the services or works in question, publication in a specialist journal corresponding to the economic sector concerned or in the Official Journal of the European Union is also necessary to ensure that reasonably vigilant economic operators who may be interested in…
