Section 1: Report presenting the procedure carried out by the contracting authorities

The contracting authority shall draw up a report presenting the procedure for awarding contracts and dynamic purchasing systems meeting a need whose value is equal to or greater than the European thresholds set out in a notice annexed to this Code.This report need not be drawn up for subsequent contracts based on a framework agreement where these are concluded without reopening competition.

The presentation report shall include at least the following information:1° The name and address of the contracting authority, the subject and value of the contract or of the dynamic purchasing system;2° The names of the candidates excluded and the reasons for the rejection of their applications;3° The names of the candidates selected and the reasons for this choice;4° The names of the tenderers whose bids were rejected and the reasons…

The presentation report also includes, where applicable, the following information: 1° The reasons for having recourse to a contract awarded without prior advertising or competitive tendering, to the procedure with negotiation or to the competitive dialogue ; 2° The reasons why the contracting authority has not allocated the contract, if it has not indicated them in the consultation documents; 3° The reasons why a minimum annual turnover in excess of…

Insofar as the award notice contains the information required by articles R. 2184-1 to R. 2184-3, the contracting authority may refer to this notice in the presentation report.

Where the contracting authority is subject to a review of its contracts, it shall send the authorities responsible for the review the presentation report at the same time as the contractual documents.

The presentation report or its main elements are communicated to the European Commission at its request.
