Section 3: Payment of a bonus

When the consultation documents for global contracts provide for the submission of services, they indicate the amount of the premium that will be paid to tenderers as well as the conditions for its reduction or elimination: 1° For the award of a design-build contract when this is awarded by a purchaser subject to the provisions of Book IV of this Part; 2° For the award of a global performance contract…

The amount of the premium awarded to each tenderer is equal to the estimated price of the design studies to be carried out as defined in the consultation documents, less a discount of no more than 20%.

When the design-build contract or the global performance contract meets a need whose estimated value exceeds the formal procedure thresholds and when its award procedure involves a jury, the premium is paid to the tenderers on the jury’s recommendation.

The remuneration of the holder of the design-build contract or the comprehensive performance contract takes account of the bonus he has received.
