Chapter IV: EXAMINATION OF APPLICATIONS

The purchaser shall verify the information contained in the application, including the economic operators on whose capabilities the applicant relies. This verification is carried out under the conditions set out in articles R. 2144-3 to R. 2144-5.

Where the purchaser establishes that documents or information required to be submitted as part of the application are missing or incomplete, he may ask all the candidates concerned to complete their application file within an appropriate period that is the same for all. The provisions of the first paragraph shall apply where the purchaser establishes that an application has been submitted in disregard of Article R. 2132-7.

Verification of the suitability to carry out the professional activity, the economic and financial capacity and the technical and professional capability of the candidates may be carried out at any time during the procedure and at the latest before the award of the contract.

The purchaser may require only the candidate to whom it is intended to award the contract to provide evidence that he does not fall within a ground for exclusion from the contract award procedure.

Where the purchaser limits the number of candidates admitted to continue the procedure, the checks referred to in articles R. 2144-1,R. 2144-3 and R. 2144-4 shall be carried out at the latest before the invitation to tender or to participate in the dialogue is sent.

The purchaser may ask the applicant to supplement or explain the supporting documents and evidence provided or obtained.

If a candidate or tenderer is in a situation of exclusion, does not meet the conditions for participation laid down by the purchaser, produces false information or documents in support of his application, or is unable to produce the supporting documents, evidence, additions or explanations required by the purchaser within the time limit laid down, his application is declared inadmissible and the candidate is eliminated.In this case, when the applications…
