Section 1: Guarantee marks

A guarantee mark is a mark so designated when filed and capable of distinguishing goods or services for which the material, method of manufacture or performance, quality, accuracy or other characteristics are guaranteed. The provisions of this Book shall apply to guarantee marks subject to the special provisions of this Section.

Any natural or legal person, including a legal person governed by public law, may file a guarantee mark, provided that such person does not engage in an activity relating to the supply of goods or services of the same type as those guaranteed. A guarantee mark may only be assigned or transferred to a person meeting the conditions set out in the first paragraph of article L. 715-2.
