Chapter III: Provisions applicable to medical reservists

The National Public Health Agency shall enter into a written secondment agreement with the reservist referred to in the first paragraph ofArticle L. 3133-1 and with each of his/her employers. Where the reservist is employed under a contract of employment, the tripartite agreement is deemed to be an amendment to this contract for each period of employment or training in the reserve.

Reservists must obtain their employer’s agreement before any absence. The employer may only object to the Reservist’s absence if it is necessary for the continued production of goods and services or for the continuity of the public service. No dismissal or professional downgrading, no disciplinary sanction may be pronounced against a reservist because of absences resulting from the application of Chapter II of this Title.

Periods of employment and training in the reserve are considered as a period of actual work for legal and contractual benefits in terms of seniority, promotion, paid leave and entitlement to social benefits. Training periods completed as part of the health reserve are covered by the continuing professional development of health professionals mentioned in article L. 4021-1.

A student’s participation in the health reserve should not have the effect of altering his or her training course.

Articles 11 and 11 bis A of law no. 83-634 of 13th July 1983 on the rights and obligations of civil servants are applicable to reservists during the periods of employment or training for which they have been called up.
