Chapter IV: CONDITIONS OF ACCESS TO THE LABOUR MARKET

Access to the labour market may be granted to the asylum seeker where the French Office for the Protection of Refugees and Stateless Persons, for reasons not attributable to the applicant, has not made a decision on the asylum application within six months of the application being lodged. .

The terms under which an unaccompanied minor who benefits from the provisions of the second paragraph of article L. 5221-5 of the Labour Code and who files an asylum application is authorised to continue his or her contract while the application is being processed are defined by decree in the Conseil d’Etat.

Asylum seekers are subject to the ordinary law rules applicable to foreign workers for the issue of a work permit. However, the administrative authority has an investigation period of two months from receipt of the application for a work permit to ensure that the employment of the foreign national complies with the conditions of ordinary law for access to the labour market. Asylum seekers who access the labour market, under the conditions provided for in this chapter, benefit from the continuing vocational training actions provided for in Article L. 6313-1 of the Labour Code.
