Section 2: Determining the amount of the allowance

Asylum seeker’s allowance is made up of a flat-rate amount, the level of which varies according to the number of people in the household, and, where applicable, an additional amount to cover the applicant’s accommodation or housing costs.

The additional amount is not paid to a claimant who has not demonstrated a need for accommodation or who has access to free accommodation or housing on any grounds.

The asylum seeker’s allowance scale can be found in the annexe 8.

The amount of the asylum seeker’s allowance to be paid monthly to each recipient is determined by the Office français de l’immigration et de l’intégration.

To determine the amount of the allowance, unmarried children are taken into account, on the date the application is registered, provided they are dependent on the recipient.Resources received by the recipient are deducted from the amount resulting from the application of articles D. 553-8 and D. 553-9.

The amount of the allowance paid is revised after the French Office for Immigration and Integration has examined the request for modification, on the date of the Office’s decision.

The birth of a child is taken into account for the calculation of the amount of the allowance from receipt of the original birth certificate and, where applicable, the certificate signed by the accommodation operator or structure responsible for supporting asylum seekers.

In the event of divorce, legal or de facto separation of spouses or cessation of cohabitation, the recipient who benefits from the child being taken into account in calculating the amount of the allowance is the person who has actual and permanent responsibility for the child. .

When the asylum seeker is joined by a family member who has reached the age of majority after filing his/her application for the allowance, the family member is taken into account in calculating the allowance if he/she was declared by the applicant when the application was registered.

The death of the beneficiary terminates entitlement to the asylum seeker’s allowance. The death of a family member terminates entitlement for the portion corresponding to that person.The beneficiary’s imprisonment or placement in detention in the cases provided for in articles L. 752-2 and L. 753-1 results in suspension of entitlement to asylum seeker’s allowance.
