Section 2: Domiciliation

The following are considered to be stable residences, within the meaning of article L. 551-7:1° The place where the person is accommodated with a title to fix their domicile there;2° The places mentioned in article L. 552-1, other than hotel establishments.

Organisations under agreement in application of article L. 550-2 or providing stable accommodation for asylum seekers will provide those concerned with a declaration of domicile, the model for which is set by order of the minister responsible for asylum.This declaration is issued to asylum seekers in possession of an asylum application certificate. The declaration of domiciliation is granted for a period of one year. It is renewable.

The declaration of direct debit also serves as proof of domicile for opening a bank account pursuant to article L. 312-1 of the Monetary and Financial Code.

All correspondence sent by post to asylum seekers is sent to the address at which they have elected domicile pursuant to article L. 551-7.

Asylum seekers with a stable address are required, in the event of a change of address, to inform the French Office for Immigration and Integration without delay. Failing this, all correspondence is sent to the last known address and is deemed to have been notified to the addressee.

The absence of an effective address may not be used against an asylum seeker to deny them the exercise of a right or access to an essential service guaranteed by law, particularly in banking and postal matters, as long as they have a valid declaration of domicile.

Organisations under agreement pursuant to article L. 550-2 provide domiciliation for asylum seekers who are referred to them by the French Office for Immigration and Integration.
