Section 2: Submission of appeals

An appeal lodged by an asylum seeker must state the applicant’s surname, first names, date and place of birth, nationality and place of residence. It shall mention the subject of the application and a statement of the factual and legal circumstances invoked in support of it. It must be drawn up in French. It must be signed by the claimant or his or her lawyer. .

The appeal is accompanied by the decision of the French Office for the Protection of Refugees and Stateless Persons. If the asylum application was placed under the accelerated procedure when it was registered, the appeal is accompanied by the information notice given to the person concerned by the administrative authority when the application was registered. An order of the Minister of Justice and the Minister responsible for asylum sets out the methods of filing or transmitting appeals, pleadings, documents and pleadings accepted by the secretariat of the National Court of Asylum.As regards electronic transmissions, this order sets out the conditions guaranteeing the reliability, integrity, security and confidentiality of exchanges.Appeals are registered according to their date of arrival at the court.

The Cour nationale du droit d’asile sends the applicant a notice of receipt of his appeal. This notice informs them of the arrangements for consulting their file.

The appeal must, on pain of inadmissibility, be lodged within one month of notification of the decision by the French Office for the Protection of Refugees and Stateless Persons. However, the time limit for appeal and the means of appeal are only enforceable if they are mentioned in the notification of the decision.

When the applicant disputes the language in which he has been heard by the French Office for the Protection of Refugees and Stateless Persons he shall indicate within the time limit for appeal the language in which he wishes to be heard. They will then be heard in that language.When their request cannot be met, they will be heard in a language they can reasonably be expected to understand.

Where an appeal is vitiated by an inadmissibility that may be covered after the expiry of the time limit for lodging an appeal, the National Court of Asylum may reject it by noting this inadmissibility of its own motion only after having invited its author to regularise it.The request for regularisation states that failing such regularisation the submissions may be rejected as inadmissible as soon as the time limit has…
