When the Deputy European Public Prosecutor hearing a request for release considers that he cannot grant the request or place the person under judicial supervision, but considers that the person could be placed under house arrest with electronic surveillance, he shall notify the liberty and custody judge when he refers the matter to him pursuant to the last paragraph of Article 696-122.

Where, in accordance with the provisions of the first paragraph of Article 696-109, the Deputy European Public Prosecutor acts as Public Prosecutor before the Investigating Chamber or the Criminal Appeals Chamber, and may lodge an appeal on points of law against decisions handed down by these courts, under the conditions set out in articles 567,568 and 585-2.
