Article 1038 of the French Code of civil procedure

The judicial court has exclusive jurisdiction to hear at first instance disputes concerning the French or foreign nationality of natural persons, subject to the provisions set out in the Civil Code for criminal courts with a criminal jury. It also has jurisdiction to hear disputes relating to the refusal to issue a certificate of French nationality provided for in article 31-3 of the Civil Code.

The exceptions of nationality and foreign nationality as well as that of lack of jurisdiction to hear them are of public order. They may be raised in any case and must be raised ex officio by the judge.

Article 1038

Le tribunal judiciaire est seul compétent pour connaître en premier ressort des contestations sur la nationalité française ou étrangère des personnes physiques, sous réserve des dispositions figurant au code civil pour les juridictions répressives comportant un jury criminel. Il est également compétent pour connaître des contestations relatives au refus de délivrance d’un certificat de nationalité française prévu à l’article 31-3 du code civil.

Les exceptions de nationalité et d’extranéité ainsi que celle d’incompétence pour en connaître sont d’ordre public. Elles peuvent être soulevées en tout état de cause et doivent être relevées d’office par le juge.
