Article 1043 of the French Code of civil procedure

Where a question of nationality is referred to a court of law as an incidental question which it is not competent to hear and which is necessary for the resolution of the dispute, the case shall be communicated to the Public Prosecutor’s Office.

The Public Prosecutor’s Office shall state, in written and reasoned submissions, whether or not it considers that there are grounds for admitting the existence of a preliminary question.

Lorsqu’une juridiction de l’ordre judiciaire est saisie à titre incident d’une question de nationalité dont elle n’est pas habile à connaître et qui est nécessaire à la solution du litige, la cause est communiquée au ministère public.

Le ministère public fait connaître, par conclusions écrites et motivées, s’il estime qu’il y a lieu ou non d’admettre l’existence d’une question préjudicielle.
