Article 1050 of the French Civil Code

The rights of the second grantee open on the death of the grantee.

However, the grantee may abandon, in favour of the second grantee, the enjoyment of the property or right which is the subject of the liberality.

This anticipated abandonment may not prejudice the creditors of the grantee prior to the abandonment, or third parties who have acquired, from the latter, a right to the property or right abandoned.

Les droits du second gratifié s’ouvrent à la mort du grevé.

Toutefois, le grevé peut abandonner, au profit du second gratifié, la jouissance du bien ou du droit objet de la libéralité.

Cet abandon anticipé ne peut préjudicier aux créanciers du grevé antérieurs à l’abandon, ni aux tiers ayant acquis, de ce dernier, un droit sur le bien ou le droit abandonné.
