Article 1085 of the French Civil Code

If the statement referred to in the preceding article has not been appended to the deed containing the gift of the present and future property, the donee will be obliged to accept or repudiate this gift for the whole. In the event of acceptance, he will only be able to claim those assets which are in existence on the day of the donor’s death, and he will be subject to the payment of all the debts and charges of the succession.

Si l’état dont est mention au précédent article n’a point été annexé à l’acte contenant donation des biens présents et à venir, le donataire sera obligé d’accepter ou de répudier cette donation pour le tout. En cas d’acceptation, il ne pourra réclamer que les biens qui se trouveront existants au jour du décès du donateur, et il sera soumis au paiement de toutes les dettes et charges de la succession.
