Article 113-3 of the French Code of Criminal Procedure

The assisted witness has the right to be assisted by a lawyer, who is notified in advance of the hearings and has access to the case file, in accordance with the provisions of Articles 114 and 114-1. This lawyer is chosen by the assisted witness or appointed ex officio by the President of the Bar if the person concerned so requests.

The assisted witness also benefits, where appropriate, from the right to interpretation and translation of the essential documents in the case file.

The assisted witness may ask the investigating judge, in accordance with the procedures laid down by Article 82-1, to be confronted with the person or persons implicating him or make motions for annulment on the basis of l’article 173.

Article 113-3

Le témoin assisté bénéficie du droit d’être assisté par un avocat qui est avisé préalablement des auditions et a accès au dossier de la procédure, conformément aux dispositions des articles 114 et 114-1. Cet avocat est choisi par le témoin assisté ou désigné d’office par le bâtonnier si l’intéressé en fait la demande.

Le témoin assisté bénéficie également, le cas échéant, du droit à l’interprétation et à la traduction des pièces essentielles du dossier.

Le témoin assisté peut demander au juge d’instruction, selon les modalités prévues par l’article 82-1, à être confronté avec la ou les personnes qui le mettent en cause ou formuler des requêtes en annulation sur le fondement de l’article 173.
