Article 1130 of the French Civil Code

Error, fraud and violence vitiate consent when they are of such a nature that, without them, one of the parties would not have contracted or would have contracted on substantially different terms.

Their decisive character is assessed having regard to the persons and circumstances in which the consent was given.

L’erreur, le dol et la violence vicient le consentement lorsqu’ils sont de telle nature que, sans eux, l’une des parties n’aurait pas contracté ou aurait contracté à des conditions substantiellement différentes.

Leur caractère déterminant s’apprécie eu égard aux personnes et aux circonstances dans lesquelles le consentement a été donné.
