Article 114 of the French Code of civil procedure

No procedural act may be declared null and void on the grounds of a defect in form unless its nullity is expressly provided for by law, except in the case of failure to observe a substantial formality or a formality of public policy.

Invalidity may only be declared if the adversary who invokes it proves the prejudice caused to him by the irregularity, even when it concerns a substantial formality or one of public order.

Aucun acte de procédure ne peut être déclaré nul pour vice de forme si la nullité n’en est pas expressément prévue par la loi, sauf en cas d’inobservation d’une formalité substantielle ou d’ordre public.

La nullité ne peut être prononcée qu’à charge pour l’adversaire qui l’invoque de prouver le grief que lui cause l’irrégularité, même lorsqu’il s’agit d’une formalité substantielle ou d’ordre public.
