Article 1180-12 of the French Code of civil procedure

The file may be consulted at the court registry by the petitioner, the minor capable of discernment, the parents or their lawyers, if they are assisted or represented, until a decision is made on the petition.

Where the provisions of articles 387-3, 387-4 or 387-5 of the Civil Code are applied, the minor capable of discernment or one of his parents and their counsel may request to consult the file at any time during the proceedings.

A minor capable of discernment may only consult the file concerning him or her in the presence of his or her parents or one of their parents or his or her lawyer. If the parents refuse and the person concerned does not have a lawyer, the judge will refer the matter to the President of the Bar with a request to appoint a lawyer to assist the minor.

By reasoned decision, the judge may, in the absence of a lawyer, exclude all or part of the documents from consultation by the applicant or the minor where such consultation would be likely to cause the latter serious harm.

In all cases, consultation may only take place on the days and at the times set by the judge.

Le dossier peut être consulté au greffe par le requérant, le mineur capable de discernement, les parents ou leurs avocats, s’ils sont assistés ou représentés, jusqu’à ce qu’il soit statué sur la requête.

Lorsqu’il est fait application des dispositions des articles 387-3, 387-4 ou 387-5 du code civil, le mineur capable de discernement ou l’un de ses parents ainsi que leurs conseils peuvent demander à consulter le dossier à tout moment de la procédure.

Le mineur capable de discernement ne peut consulter le dossier le concernant qu’en présence de ses parents ou de l’un d’eux ou de son avocat. En cas de refus des parents et si l’intéressé n’a pas d’avocat, le juge saisit le bâtonnier d’une demande de désignation d’un avocat pour assister le mineur.

Par décision motivée, le juge peut, en l’absence d’avocat, exclure tout ou partie des pièces de la consultation par le requérant ou le mineur lorsque cette consultation serait de nature à causer à ce dernier un préjudice grave.

Dans tous les cas, la consultation ne peut se faire qu’aux jours et heures fixés par le juge.
