Article 1210-5 of the French Code of civil procedure

Actions brought on the basis of the provisions of international and European instruments relating to the unlawful international removal of children are brought before the family affairs judge of the court with territorial jurisdiction pursuant to article L. 211-12 of the code of judicial organisation.

A request for a ban on the child leaving French territory without the authorisation of both parents shall also be brought before the judge referred to in the first paragraph when that judge is seised of a request for the child’s return or when the request is made by the public prosecutor pursuant to article 1210-4.

Les actions engagées sur le fondement des dispositions des instruments internationaux et européens relatives au déplacement illicite international d’enfants sont portées devant le juge aux affaires familiales du tribunal judiciaire territorialement compétent en application de l’article L. 211-12 du code de l’organisation judiciaire.

Est également portée devant le juge mentionné au premier alinéa la demande tendant à l’interdiction de sortie de l’enfant du territoire français sans l’autorisation des deux parents lorsque ce juge est saisi d’une demande de retour de l’enfant ou lorsque la demande est formée par le procureur de la République en application de l’article 1210-4.
