Article 129-5 of the French Code of civil procedure

The judge may terminate the conciliation at any time, at the request of a party or on the conciliator’s initiative. He may also terminate the conciliation automatically if it appears that the conciliation is being compromised. The court clerk notifies the conciliator and the parties.

Le conciliateur de justice tient le juge informé des difficultés qu’il rencontre dans l’accomplissement de sa mission, ainsi que de la réussite ou de l’échec de la conciliation.


Le juge peut mettre fin à tout moment à la conciliation, à la demande d’une partie ou à l’initiative du conciliateur. Il peut également y mettre fin d’office lorsque le bon déroulement de la conciliation apparaît compromis. Le greffier en avise le conciliateur et les parties.
