Article 1303-1 of the French Code of civil procedure

Where the marriage record is kept by a French authority, that authority shall mention in the margin of that record, at the request of the spouses or of one of them, the record designating the law applicable to the matrimonial property regime, publication of which is provided for in second paragraph of article 1397-3 of the Civil Code.

In the absence of a marriage record kept by a French authority, and if the record designating the law applicable to the matrimonial property regime has been drawn up in France in authentic form or if one of the spouses is French, the said record or the certificate issued by the person competent to draw it up is, at the request of the spouses or of one of them, entered for safekeeping in the annexed civil register referred to in Article 4-1 of Decree No 65-422 of 1 June 1965 creating a central civil status service at the Ministry of Foreign Affairs.

Lorsque l’acte de mariage est conservé par une autorité française, celle-ci mentionne en marge de cet acte, à la demande des époux ou de l’un d’eux, l’acte portant désignation de la loi applicable au régime matrimonial, dont la publication est prévue au deuxième alinéa de l’article 1397-3 du code civil.

En l’absence d’acte de mariage conservé par une autorité française, et si l’acte portant désignation de la loi applicable au régime matrimonial a été établi en France en la forme authentique ou si l’un des époux est français, ledit acte ou le certificat délivré par la personne compétente pour l’établir est, à la demande des époux ou de l’un deux, inscrit aux fins de conservation au répertoire civil annexe mentionné à l’article 4-1 du décret n° 65-422 du 1er juin 1965 portant création d’un service central d’état civil au ministère des affaires étrangères.
