Article 1363 of the French Code of civil procedure

If lots are to be drawn, this shall be done before the notary appointed pursuant to the second paragraph of Article 1361 and, failing that, before the president of the judicial court or his delegate.

If an heir is in default, the president of the judicial court or his delegate may, ex officio, when the draw takes place before him or on transmission of the minutes drawn up by the notary, appoint a representative to the defaulting heir.

Article 1363

S’il y a lieu au tirage au sort des lots, celui-ci est réalisé devant le notaire commis en application du second alinéa de l’article 1361 et, à défaut, devant le président du tribunal judiciaire ou son délégué.

Si un héritier est défaillant, le président du tribunal judiciaire ou son délégué peut, d’office, lorsque le tirage au sort a lieu devant lui ou sur transmission du procès-verbal dressé par le notaire, désigner un représentant à l’héritier défaillant.
