Article 1365 of the French Code of civil procedure

The notary shall summon the parties and request the production of any document useful to the accomplishment of his mission.

He shall report to the judge assigned the difficulties encountered and may request from him any measure likely to facilitate the progress thereof.

He may, if the value or consistency of the property justifies it, appoint an expert, chosen by mutual agreement between the parties or, failing that, designated by the judge assigned.

Le notaire convoque les parties et demande la production de tout document utile à l’accomplissement de sa mission.

Il rend compte au juge commis des difficultés rencontrées et peut solliciter de lui toute mesure de nature à en faciliter le déroulement.

Il peut, si la valeur ou la consistance des biens le justifie, s’adjoindre un expert, choisi d’un commun accord entre les parties ou, à défaut, désigné par le juge commis.
