Article 138-3 of the French Code of Criminal Procedure

In the case of an offence punishable by at least three years’ imprisonment committed against the victim’s spouse, cohabitee or partner linked to the victim by a civil solidarity pact, including when they are not cohabiting, or committed by the victim’s former spouse or cohabitee or by the partner who was linked to the victim by a civil solidarity pact, the judge may, at the request or with the express consent of the victim, which may be obtained by any means:

1° Prohibit the person placed under judicial supervision from approaching the victim at less than a certain distance set by the decision;

2° And, in order to ensure compliance with the prohibition provided for in 1°, require this person to wear, for the entire duration of the placement, a bracelet incorporating a transmitter enabling his or her location throughout national territory to be determined remotely at any time and if he or she approaches the victim who has been allocated an electronic device that also enables his or her location to be determined.

The person placed under judicial supervision is informed that the bracelet cannot be fitted without his or her consent, but that refusal to have it fitted constitutes a breach of his or her obligations and may result in the revocation of the measure and his or her placement in pre-trial detention. This system is approved by the Minister of Justice. Its implementation must guarantee respect for the person’s dignity, integrity and privacy and must not hinder his or her social integration.

The provisions of this article are specified by decree in the Council of State. This decree by the Council of State, issued after consultation with the Commission nationale de l’informatique et des libertés, authorises the implementation of automated processing of personal data ensuring remote monitoring of the location of the person placed under judicial supervision and the victim; these provisions may extend the purposes of the processing provided for in Article 763-13. The persons contributing to this remote monitoring, which may not result in requiring the presence of the person placed under judicial supervision in certain places, may be private persons authorised under the conditions laid down by this decree.

Article 138-3

En cas d’infraction punie d’au moins trois ans d’emprisonnement commise contre son conjoint, son concubin ou le partenaire lié à elle par un pacte civil de solidarité, y compris lorsqu’ils ne cohabitent pas, ou commise par l’ancien conjoint ou concubin de la victime ou par le partenaire ayant été lié à elle par un pacte civil de solidarité, le juge peut, à la demande ou avec le consentement exprès de la victime, qui peut être recueilli par tout moyen :

1° Interdire à la personne placée sous contrôle judiciaire de se rapprocher de la victime à moins d’une certaine distance fixée par la décision ;

2° Et, afin d’assurer le respect de l’interdiction prévue au 1°, astreindre cette personne au port, pendant toute la durée du placement, d’un bracelet intégrant un émetteur permettant à tout moment de déterminer à distance sa localisation sur l’ensemble du territoire national et si elle s’approche de la victime à qui a été attribué un dispositif électronique permettant également sa localisation.

La personne placée sous contrôle judiciaire est avisée que la pose du bracelet ne peut être effectuée sans son consentement mais que le fait de la refuser constitue une violation des obligations qui lui incombent et peut donner lieu à la révocation de la mesure et à son placement en détention provisoire. Ce dispositif est homologué par le ministre de la justice. Sa mise en œuvre doit garantir le respect de la dignité, de l’intégrité et de la vie privée de la personne et ne pas entraver son insertion sociale.

Les dispositions du présent article sont précisées par décret en Conseil d’Etat. Ce décret en Conseil d’Etat, pris après avis de la Commission nationale de l’informatique et des libertés, autorise la mise en œuvre d’un traitement automatisé de données à caractère personnel assurant le contrôle à distance de la localisation de la personne placée sous contrôle judiciaire et de la victime ; ces dispositions peuvent étendre les finalités du traitement prévu à l’article 763-13. Les personnes contribuant à ce contrôle à distance, qui ne peut conduire à imposer la présence de la personne placée sous contrôle judiciaire dans certains lieux, peuvent être des personnes privées habilitées dans des conditions prévues par ce décret.
