Article 1381-3 of the French Code of civil procedure

In the event of refusal to issue a European Certificate of Succession, the notary will inform the applicant by registered letter with acknowledgement of receipt.

In the event of withdrawal of the European Certificate of Succession, suspension of its effects or refusal to proceed with its rectification, amendment, withdrawal or suspension of its effects under the conditions provided for in Articles 71 and 73 of Regulation No 650/2012 of the Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and to the creation of a European Certificate of Succession, the notary shall inform, under the same conditions, the persons who were issued with a certified copy of the initial certificate.

The notary shall inform those concerned of the reasons for his decision and indicate the appeal procedures.

En cas de refus de délivrer un certificat successoral européen, le notaire informe le demandeur par lettre recommandée avec demande d’avis de réception.


En cas de retrait du certificat successoral européen, de suspension de ses effets ou de refus de procéder à sa rectification, sa modification, son retrait ou à la suspension de ses effets dans les conditions prévues aux articles 71 et 73 du règlement n° 650/2012 du Parlement et du Conseil du 4 juillet 2012 relatif à la compétence, la loi applicable, la reconnaissance et l’exécution des décisions, et l’acceptation et l’exécution des actes authentiques en matière de successions et à la création d’un certificat successoral européen, le notaire informe, dans les mêmes conditions, les personnes qui se sont vues délivrer une copie certifiée conforme du certificat initial.


Le notaire informe les intéressés des motifs de sa décision et indique les voies de recours.
