Article 1409 of the French Code of civil procedure

If, on the basis of the documents produced, the judge considers the claim to be well-founded in whole or in part, the judge shall make an order for payment of the sum that he or she retains.

If the judge rejects the claim, his or her decision shall be without recourse for the creditor, unless he or she proceeds in accordance with the ordinary law.

If the judge upholds the application only in part, his decision is also without appeal for the creditor, unless the creditor does not serve the order and proceeds in accordance with the ordinary law.

Article 1409

Si, au vu des documents produits, la demande lui paraît fondée en tout ou partie, le juge rend une ordonnance portant injonction de payer pour la somme qu’il retient.

Si le juge rejette la requête, sa décision est sans recours pour le créancier, sauf à celui-ci à procéder selon les voies de droit commun.

Si le juge ne retient la requête que pour partie, sa décision est également sans recours pour le créancier, sauf à celui-ci à ne pas signifier l’ordonnance et à procéder selon les voies de droit commun.
