Article 1475 of the French General Tax Code

The rental values of hydroelectric facilities under concession or with a capacity of more than 500 kilowatts are apportioned between the communes in whose territory the watercourses used or civil engineering works exist, taking into account the size of the latter, the possible existence of water reservoirs and the average hydraulic capacity that has become unavailable within the boundary of each commune as a result of the plant; the percentages fixing this apportionment are determined by the authorisation or concession deed.

A decree issued on the proposal of the Minister for the Economy and Finance, the Minister for the Interior and the Minister for Industry specifies the method for determining the percentages provided for in the first paragraph as well as the conditions for applying this paragraph (1).

Article 1475

Les valeurs locatives des ouvrages hydro-électriques concédés ou d’une puissance supérieure à 500 kilowatts sont réparties entre les communes sur le territoire desquelles coulent les cours d’eau utilisés ou existent des ouvrages de génie civil, compte tenu de l’importance de ces derniers, de l’existence éventuelle de retenues d’eau et de la puissance hydraulique moyenne devenue indisponible dans la limite de chaque commune, du fait de l’usine ; les pourcentages fixant cette répartition sont déterminés par l’acte d’autorisation ou de concession.

Un décret rendu sur la proposition du ministre de l’économie et des finances, du ministre de l’intérieur et du ministre de l’industrie précise le mode de détermination des pourcentages prévus au premier alinéa ainsi que les conditions d’application de cet alinéa (1).
