Article 1497 of the French Civil Code

The spouses may, in their marriage contract, modify the legal community by any kind of agreement not contrary to articles 1387, 1388 and 1389.

They may, in particular, agree:

1° That the community will include movables and acquests;

2° That there will be a derogation from the rules concerning administration;

3° That one of the spouses will have the option of taking certain assets in return for compensation;

4° That one of the spouses will have a preciput;

5° That the spouses will have unequal shares;

6° That there will be a universal community between them.

The rules of the legal community remain applicable on all points that have not been the subject of the parties’ agreement.

Article 1497

Les époux peuvent, dans leur contrat de mariage, modifier la communauté légale par toute espèce de conventions non contraires aux articles 1387, 1388 et 1389.

Ils peuvent, notamment, convenir :

1° Que la communauté comprendra les meubles et les acquêts ;

2° Qu’il sera dérogé aux règles concernant l’administration ;

3° Que l’un des époux aura la faculté de prélever certains biens moyennant indemnité ;

4° Que l’un des époux aura un préciput ;

5° Que les époux auront des parts inégales ;

6° Qu’il y aura entre eux communauté universelle.

Les règles de la communauté légale restent applicables en tous les points qui n’ont pas fait l’objet de la convention des parties.
