Article 1499 of the French Civil Code

Under this regime, in addition to the debts that would form part of it under the legal regime, a fraction of the debts of which the spouses were already burdened when they married, or of which they are burdened by successions and gifts that fall to them during the marriage, are included in the joint liabilities.

The fraction of liabilities that the community must bear is proportional to the fraction of assets that it receives, according to the rules of the preceding article, either in the assets of the spouse on the day of the marriage, or in all the property that is the subject of the succession or liberality.

To establish this proportion, the consistency and value of the assets shall be proved in accordance with article 1402.

Entrent dans le passif commun, sous ce régime, outre les dettes qui en feraient partie sous le régime légal, une fraction de celles dont les époux étaient déjà grevés quand ils se sont mariés, ou dont se trouvent chargées des successions et libéralités qui leur échoient durant le mariage.

La fraction de passif que doit supporter la communauté est proportionnelle à la fraction d’actif qu’elle recueille, d’après les règles de l’article précédent, soit dans le patrimoine de l’époux au jour du mariage, soit dans l’ensemble des biens qui font l’objet de la succession ou libéralité.

Pour l’établissement de cette proportion, la consistance et la valeur de l’actif se prouvent conformément à l’article 1402.
