Article 1555-1 of the French Code of civil procedure

Where it has been possible to reach at least a partial agreement, this is recorded in a private deed drawn up under the conditions set out in Article 1374 of the Civil Code. It sets out in detail the elements that enabled the agreement to be reached.

Where the participatory procedure agreement has been concluded for the purposes of pre-trial proceedings, the agreement referred to in the first paragraph shall be sent to the court no later than the date of the hearing at which the pre-trial proceedings will be closed.

Where the participatory procedure agreement is concluded in the context of proceedings without a preliminary hearing, the agreement referred to in the first paragraph shall be sent to the court no later than the day of the hearing.

Lorsqu’un accord au moins partiel a pu être conclu, il est constaté dans un acte sous signature privée établi dans les conditions prévues à l’article 1374 du code civil. Il énonce de manière détaillée les éléments ayant permis la conclusion de cet accord.


Lorsque la convention de procédure participative a été conclue aux fins de mise en état, l’accord mentionné au premier alinéa est adressé à la juridiction au plus tard à la date de l’audience à laquelle l’instruction sera clôturée.


Lorsque la convention de procédure participative est conclue dans le cadre d’une procédure sans mise en état, l’accord mentionné au premier alinéa est adressé à la juridiction au plus tard le jour de l’audience.
