Article 1649 quater A of the French General Tax Code

Cash transfers, within the meaning of Regulation (EU) 2018/1672 of the European Parliament and of the Council of 23 October 2018 on controls of cash entering or leaving the Union and repealing Regulation (EC) No 1889/2005 carried out by natural persons to or from a Member State of the European Union are carried out in accordance with Articles L. 152-1 to L. 152-1-2 of the Monetary and Financial Code.

Cash, within the meaning of Regulation (EU) 2018/1672 of the European Parliament and of the Council of 23 October 2018 referred to above, transferred to or from abroad constitutes, in the absence of proof to the contrary, taxable income where the taxpayer has not fulfilled the obligations set out in Articles L. 152-1 to L. 152-1-2 of the Monetary and Financial Code and Regulation (EU) 2018/1672 of the European Parliament and of the Council of 23 October 2018 referred to above.

Article 1649 quater A

Les transferts d’argent liquide, au sens du règlement (UE) 2018/1672 du Parlement européen et du Conseil du 23 octobre 2018 relatif aux contrôles de l’argent liquide entrant dans l’Union ou sortant de l’Union et abrogeant le règlement (CE) n° 1889/2005 réalisés par des personnes physiques vers un Etat membre de l’Union européenne ou en provenance d’un Etat membre de l’Union européenne sont effectués conformément aux articles L. 152-1 à L. 152-1-2 du code monétaire et financier.

L’argent liquide, au sens du règlement (UE) 2018/1672 du Parlement européen et du Conseil du 23 octobre 2018 précité, transféré vers l’étranger ou en provenance de l’étranger constitue, sauf preuve contraire, un revenu imposable lorsque le contribuable n’a pas rempli les obligations prévues aux articles L. 152-1 à L. 152-1-2 du code monétaire et financier et au règlement (UE) 2018/1672 du Parlement européen et du Conseil du 23 octobre 2018 précité.
