Article 1693 ter A of the French General Tax Code

The value added tax credit recognised by a taxable person who is a member of the group in respect of a period prior to the entry into force of the option provided for in Article 1693 ter may not be carried forward on a return whose elements are taken into account for the calculation of the difference mentioned in b of 3 of the same article. This credit gives rise to reimbursement to this member under the conditions provided for in IV of Article 271.

The value added tax credit recorded on the return mentioned in c of 1 of Article 1693 ter during the application of the optional scheme provided for in the same article cannot be carried forward to a subsequent return by the taxable person who is a member of the group. It is definitively transmitted to the taxpayer mentioned in the same 1 under the conditions mentioned in b of 3 of the same article.

Le crédit de taxe sur la valeur ajoutée constaté par un assujetti membre du groupe au titre d’une période antérieure à l’entrée en vigueur de l’option prévue à l’article 1693 ter ne peut faire l’objet d’un report sur une déclaration dont les éléments sont pris en compte pour le calcul de la différence mentionnée au b du 3 du même article. Ce crédit donne lieu à remboursement à ce membre dans les conditions prévues au IV de l’article 271.

Le crédit de taxe sur la valeur ajoutée constaté sur la déclaration mentionnée au c du 1 de l’article 1693 ter pendant l’application du régime optionnel prévu au même article ne peut faire l’objet d’un report sur une déclaration ultérieure de l’assujetti membre du groupe. Il est définitivement transmis au redevable mentionné au même 1 dans les conditions mentionnées au b du 3 du même article.
