Article 178-1 of the French Code of civil procedure

Where an investigative measure ordered abroad pursuant to Regulation (EU) 2020/1783 of the European Parliament and of the Council of 25 November 2020 on cooperation between the courts of the Member States in the taking of evidence in civil or commercial matters (taking of evidence) (recast), gives rise to costs for the translation of the forms to be sent to the requested court, the judge shall order the payment of an advance on those costs, the amount of which shall be fixed in accordance with the tariff provided for in article R. 122 of the Code of Criminal Procedure. The judge shall designate the party or parties who must pay the advance to the court registry within the period he or she determines in accordance with the procedures set out in articles 270 and 271 of this code.

As soon as the translation is received, the registry pays its remuneration to the translator.

Article 178-1

Lorsqu’une mesure d’instruction ordonnée à l’étranger en application du règlement (UE) 2020/1783 du Parlement européen et du Conseil du 25 novembre 2020 relatif à la coopération entre les juridictions des Etats membres dans le domaine de l’obtention des preuves en matière civile et commerciale (obtention des preuves) (refonte), occasionne des frais pour la traduction des formulaires qui doivent être adressés à la juridiction requise, le juge ordonne le versement d’une provision à valoir sur ces frais, dont le montant est fixé en application du tarif prévu à l’article R. 122 du code de procédure pénale. Le juge désigne la ou les parties qui devront verser la provision au greffe de la juridiction dans le délai qu’il détermine suivant les modalités prévues par les articles 270 et 271 du présent code.

Dès réception de la traduction, le greffe verse sa rémunération au traducteur.
