Consent to the divorce and its effects cannot be presumed.
The agreement shall expressly include, on pain of nullity:
1° The surname, forenames, profession, residence, nationality, date and place of birth of each of the spouses, the date and place of marriage, as well as the same particulars, where applicable, for each of their children;
2° The name, professional address and professional practice structure of the lawyers instructed to assist the spouses, as well as the bar at which they are registered;
3° A mention of the spouses’ agreement to the breakdown of the marriage and its effects in the terms set out in the agreement ;
4° The arrangements for the full settlement of the effects of the divorce in accordance with Chapter III of this Title, in particular if there is to be payment of a compensatory allowance ;
5° The liquidation statement of the matrimonial property regime, where applicable in notarised form where the liquidation concerns property subject to land registration, or the declaration that there is no need for liquidation;
6° A statement that the minor has been informed by his or her parents of his or her right to be heard by the judge under the conditions provided for in Article 388-1 and that he or she does not wish to make use of this option.
