Article 2464 of the French Civil Code

Failing the agreement provided for in the preceding article, the third party purchaser may, once the sale has been published, purge the property of the right of pursuit attached to the mortgage.

He must, either before the proceedings, or within one month of the first summons to pay made to him, notify the registered creditors of a deed in which he states that he is prepared to pay the mortgage debts, whether due or not, forthwith, but up to the price stipulated in the deed of acquisition or, if he has received the property by gift, the value he declares.

A défaut de l’accord prévu par l’article précédent, le tiers acquéreur peut, une fois la vente publiée, purger l’immeuble du droit de suite attaché à l’hypothèque.


Il doit, soit avant les poursuites, soit dans le mois de la première sommation de payer qui lui est faite, notifier aux créanciers inscrits un acte où il dit être prêt à acquitter sur-le-champ les dettes hypothécaires, exigibles ou non exigibles, mais jusqu’à concurrence du prix stipulé dans l’acte d’acquisition ou, s’il a reçu l’immeuble par donation, de la valeur qu’il déclare.
