Where the debtor is unable to pay the capital sum under the conditions set out in article 274, the judge shall determine the terms of payment of the capital, up to a limit of eight years, in the form of periodic payments indexed in accordance with the rules applicable to maintenance payments.
The debtor may request a review of these payment arrangements in the event of a material change in his or her circumstances. Exceptionally, the judge may then, by special reasoned decision, authorise the capital to be paid over a total period of more than eight years.
The debtor may release the balance of the index-linked capital at any time.
After the matrimonial property regime has been liquidated, the creditor of the compensatory allowance may apply to the judge for payment of the balance of the index-linked capital.
