Article 287 of the French Customs Code

1. On the joint proposal of the Minister for the Economy and Finance and the Minister(s) concerned, after consultation with the local authorities and public establishments concerned, the free zone is established by a decree issued by the Council of State, which determines the operating procedures and boundaries of the zone and specifies the operations that will be authorised therein.

2. The decree establishing the free zone grants it to one of the local authorities or public establishments concerned. If the free zone is established in a port, the local authority or public institution holding the concession for the free zone is the local authority or public institution holding the concession for the port facilities or, if the port is autonomous, the autonomous port.

Article 287

1. La zone franche est instituée, sur proposition conjointe du ministre de l’économie et des finances et du ou des ministres intéressés, après avis des collectivités locales et des établissements publics concernés, par un décret pris en Conseil d’Etat, qui détermine les modalités de fonctionnement et les limites de la zone et précise les opérations qui y seront autorisées.

2. Le décret institutif concède la zone franche à une des collectivités locales ou à l’un des établissements publics concernés. Si la zone franche est établie dans un port, la collectivité locale ou l’établissement public concessionnaire de la zone franche est la collectivité locale ou l’établissement public concessionnaire des installations portuaires ou, si le port est placé sous le régime de l’autonomie, le port autonome.
