Article 338 of the French Customs Code

1. The courts may not admit against customs reports any invalidity other than those resulting from the omission of the formalities prescribed by articles 323-1, 324 to 332 and 334 above.

2. However, any seizure of goods not prohibited for import or export which have passed a customs office on the front of which the notice board provided for in article 48 above has not been affixed shall be null and void.

Article 338

1. Les tribunaux ne peuvent admettre contre les procès-verbaux de douane d’autres nullités que celles résultant de l’omission des formalités prescrites par les articles 323-1,324 à 332 et 334 ci-dessus.

2. Toutefois, sera nulle et de nul effet toute saisie de marchandises non prohibées à l’importation ou à l’exportation qui auraient dépassé un bureau de douane sur la façade duquel le tableau prévu à l’article 48 ci-dessus n’aurait pas été apposé.
