Article 371-1 of the French Code of Criminal Procedure

The court may reserve its decision on the civil action.

It may also, after hearing the observations of the parties, postpone this decision to a later hearing, the date of which it shall fix. This postponement is automatic at the request of the civil parties.

The hearing on civil interests takes place at the judicial court in whose jurisdiction the assizes were held.

Unless the civil party or the accused has requested the benefit of collegiality at the time of the referral, the president of the assize court shall rule alone and may take the decisions provided for in this section.

The hearing is public. The presence of the public prosecutor is not obligatory.

La cour peut mettre en délibéré sa décision sur l’action civile.

Elle peut également, après avoir recueilli les observations des parties, renvoyer cette décision à une audience ultérieure dont elle fixe la date. Ce renvoi est de droit à la demande des parties civiles.

L’audience sur les intérêts civils a lieu au tribunal judiciaire dans le ressort duquel se sont tenues les assises.

Sauf si la partie civile ou l’accusé a sollicité lors du renvoi le bénéfice de la collégialité, le président de la cour d’assises statue seul et peut prendre les décisions prévues à la présente section.

L’audience est publique. La présence du ministère public n’est pas obligatoire.
