Article 373-1 of the French Civil Code

If one of the father and mother dies or is deprived of the exercise of parental authority, the other shall exercise this authority alone, unless he or she has been deprived of it by a previous court decision.

Si l’un des père et mère décède ou se trouve privé de l’exercice de l’autorité parentale, l’autre exerce seul cette autorité, à moins qu’il en ait été privé par une décision judiciaire antérieure.
