Article 386 bis of the French Customs Code

In the event of an indictment for the offence provided for in article 415 and in order to guarantee payment of the fines incurred, legal costs and confiscation, the president of the judicial court may order, at the request of the customs administration and after obtaining the opinion of the public prosecutor, at the advanced expense of the Treasury and in accordance with the procedures provided for in the code of civil procedure, precautionary measures on the property of the person charged.

A conviction validates the precautionary seizures and allows the definitive registration of the securities.

If the case is dismissed, acquitted or discharged, the measures ordered are automatically released at the Treasury’s expense. The same applies if the prosecution is terminated.

Article 386 bis

En cas d’inculpation du chef de l’infraction prévue à l’article 415 et afin de garantir le paiement des amendes encourues, des frais de justice et la confiscation, le président du tribunal judiciaire peut ordonner, à la demande de l’administration des douanes et après avis du procureur de la République, aux frais avancés du Trésor et selon les modalités prévues par le code de procédure civile, des mesures conservatoires sur les biens de la personne inculpée.

La condamnation vaut validation des saisies conservatoires et permet l’inscription définitive des sûretés.

La décision de non-lieu, de relaxe ou d’acquittement emporte de plein droit, aux frais du Trésor, mainlevée des mesures ordonnées. Il en est de même en cas d’extinction de l’action publique.
