The discontinuance is perfected only by the defendant’s acceptance.

However, acceptance is not necessary if the defendant has not presented any defence on the merits or plea of inadmissibility at the time the plaintiff withdraws.

Le désistement n’est parfait que par l’acceptation du défendeur.

Toutefois, l’acceptation n’est pas nécessaire si le défendeur n’a présenté aucune défense au fond ou fin de non-recevoir au moment où le demandeur se désiste.
