Article 511-12 of the French Cinema and Moving Image Code

The aid is awarded in the form of a grant, an advance or both.
The choice of the form of aid and any resulting split between grant and advance are determined according to the characteristics of the work, its distribution prospects and the economic conditions under which the project is carried out.
The aid is the subject of an agreement concluded with the beneficiary.
This agreement sets out the beneficiary’s commitments, particularly with regard to the award criteria. In the case of advances, the agreement also sets out the repayment schedule.
The agreement may also set out the conditions under which the Centre national du cinéma et de l’image animée may benefit from reproduction and performance rights for the work with a view to use as part of its mission to promote the film heritage as set out in 5° of article L. 111-2 of the Code du cinéma et de l’image animée.

Article 511-12

L’aide est attribuée sous forme de subvention, d’avance ou cumulativement sous ces deux formes.
Le choix de la forme de l’aide et l’éventuelle répartition entre subvention et avance qui en découle sont déterminés en fonction des caractéristiques de l’œuvre, de ses perspectives de diffusion et des conditions économiques de réalisation du projet.
L’aide fait l’objet d’une convention conclue avec le bénéficiaire.
Cette convention fixe les engagements du bénéficiaire au regard notamment des critères d’attribution. S’agissant des avances, la convention fixe également l’échéancier de remboursement.
La convention peut également prévoir les conditions dans lesquelles le Centre national du cinéma et de l’image animée peut bénéficier de droits de reproduction et de représentation de l’œuvre en vue d’une utilisation dans le cadre de sa mission de valorisation du patrimoine cinématographique prévue au 5° de l’article L. 111-2 du code du cinéma et de l’image animée.
