Article 52 ter of the French Customs Code

I. – Candidates who meet the following conditions may be admitted to the Customs Administration’s operational reserve, under 2° of article 52 bis:

1° Be of French nationality ;

2° Be aged between eighteen and sixty-seven;

3° Must not have been convicted of a criminal offence or a misdemeanour listed in bulletin no. 2 of the criminal record, or have been disqualified from holding public office;

4° Have the special health conditions required to work in the reserve, the conditions of which are laid down by order of the Minister responsible for the budget;

5° Have fulfilled their national service obligations.

No one may be admitted to the reserve if the administrative investigation, which may be carried out under the conditions provided for in I of article L. 114-1 of the Internal Security Code, shows that the applicant’s behaviour is incompatible with the planned missions.

II. – Retired members of the customs administration who apply to join the operational reserve must not have been the subject of a disciplinary sanction for reasons incompatible with the performance of their duties in the operational reserve.

Article 52 ter

I. – Peuvent être admis dans la réserve opérationnelle de l’administration des douanes, au titre du 2° de l’article 52 bis, les candidats qui satisfont aux conditions suivantes :

1° Etre de nationalité française ;

2° Etre âgé d’au moins dix-huit et au plus de soixante-sept ans ;

3° Ne pas avoir été condamné soit à la perte des droits civiques ou à l’interdiction d’exercer un emploi public, soit à une peine criminelle ou correctionnelle inscrite au bulletin n° 2 du casier judiciaire ;

4° Posséder les conditions de santé particulières requises pour exercer une activité dans la réserve, dont les conditions sont prévues par arrêté du ministre chargé du budget ;

5° Etre en règle au regard des obligations du service national.

Nul ne peut être admis dans la réserve s’il résulte de l’enquête administrative, à laquelle il peut être procédé dans les conditions prévues au I de l’article L. 114-1 du code de la sécurité intérieure, que le comportement du candidat est incompatible avec les missions envisagées.

II. – Les retraités de l’administration des douanes candidats à la réserve opérationnelle ne doivent pas avoir fait l’objet d’une sanction disciplinaire pour des motifs incompatibles avec l’exercice des missions dans la réserve opérationnelle.
