Article 529-5 of the French Code of Criminal Procedure

Within the period stipulated in the previous article, the offender must pay the amount due under the transaction, unless he lodges a protest with the operator’s department within three months of the offence being recorded. This protest, together with the official statement of offence, is forwarded to the Public Prosecutor’s Office.

Failing payment or protest within the aforementioned three-month period, the official statement of offence is forwarded by the operator to the Public Prosecutor’s Office and the offender automatically becomes liable for an increased fixed fine recovered by the Public Treasury by virtue of a title made enforceable by the Public Prosecutor’s Office.

Dans le délai prévu par l’article précédent, le contrevenant doit s’acquitter du montant des sommes dues au titre de la transaction, à moins qu’il ne formule dans le délai de trois mois à compter de la constatation de l’infraction une protestation auprès du service de l’exploitant. Cette protestation, accompagnée du procès-verbal d’infraction, est transmise au ministère public.

A défaut de paiement ou de protestation dans le délai de trois mois précité, le procès-verbal d’infraction est adressé par l’exploitant au ministère public et le contrevenant devient redevable de plein droit d’une amende forfaitaire majorée recouvrée par le Trésor public en vertu d’un titre rendu exécutoire par le ministère public.
